A. The Town Magistrate shall be the presiding officer of the Magistrate Court and shall be selected by the Council. The Magistrate shall perform those functions necessary for the maintenance and operation of Magistrate Court as provided by State statute.

B. The Magistrate shall serve for a term of two (2) years with the beginning of the term to be specified at the time of appointment.
