A. Pursuant to A.R.S. § 9-240(B)(28)(a), the Town has the power to “make, amend or repeal all ordinances necessary or proper for the carrying into effect of the powers vested in the [Town], or any department or officer thereof.” Id.

B. Pursuant to A.R.S. § 9-511(A), the Town may engage in any business or enterprise which may be engaged in by persons by virtue of a franchise from the Town, and may construct, purchase, acquire, own and maintain within or without its corporate limits any such business or enterprise [including] sites and rights-of-way for public utility...purposes, and for the location thereon of waterworks...” Id.
